2. General terms and conditions of use of the website and of the services provided.

The use of the website implies full acceptance of the clauses and terms of the general conditions described hereafter. These conditions of use may be subject to modifications and additions at any time. The users of the website are invited to consult them regularly.

This website is normally accessible 24 hours a day and 7 days a week. COMLIN can however decide to interrupt it for technical maintenance reasons. In this case, COMLIN will strive to communicate prior to the interruption on the dates and hours of the technical intervention.

The website is regularly updated by COMLIN. Similarly, legal mentions may be amended at any time; they are binding on the user, who is therefore advised to check them as often as possible.


3. Description of the services provided.

The website is intended to provide information on all of the activities of the COMLIN union.

The COMLIN union strives to provide the most accurate information possible on the website. However, COMLIN shall not be held liable for any omissions, inaccuracies or deficiencies in updates, whether of its own doing or of that of partner third parties providing the information concerned.

All the information mentioned on the website is given as an indication and is likely to evolve. Besides, the information on the website is not exhaustive. The information might be subject to change due to some modifications made since the site has been put on line.


4. Contractual limitations on technical data.

This website uses the JavaScript technology.

The internet website shall not be held responsible for the material damages linked to the use of the website. Besides, the website users undertake to access the site using recent virus free material and with a last generation web browser.


5. Intellectual property and counterfeiting.

COMLIN holds all intellectual property rights, or holds the user rights on all elements accessible on the website, mainly texts, images, graphs, logo, icons, sounds, software.

Any reproduction, representation, adaptation, modification, publication of all or part of the website elements is forbidden, whatever the means or the processes except prior written authorization of COMLIN.

Any unauthorized exploitation of the website or of any element that it contains shall be deemed to constitute an infringement and subject to legal proceedings in accordance with the provisions of articles L.335-2 and with the French Intellectual Property Code.


6. Limitation of Liability.

COMLIN cannot be held responsible for the direct and indirect damages caused to the hardware of the user when visiting the website, and arising either from the use of a hardware that does not meet the specifications stated point 4 or due to the appearance of a bug or incompatibility.

Besides, COMLIN cannot be held responsible of the indirect damages arising from the use of the website (such as a market loss or missed opportunities).

Interactive areas are available for users (possibility to ask questions in the contact area). COMLIN reserves the right to remove User Content at its sole discretion and without prior notice, if this content contravenes the legislation applicable in France, and particularly concerning the protection of personal data.

If necessary, COMLIN reserves the right to involve civil or criminal responsibility of the user, especially in case of contents with racist, offensive, defamatory or pornographic character, whatever the medium used (text, photo…)


7. Personal data management.

In France, personal data are protected especially by the laws n° 78-87 dated January 6,th 1978, n° 2004-801 of august, 6th 2004, the article L. 226-13, the penal Code and the European Directive of October, 24th 1995.

When visiting the website, the following data can be collected: The URL Internet address of the links via which the user accesses the website, the user’s internet provider, the user’s internet protocole (IP) address.

In any case COMLIN shall collect the user personal data only when the user provides such information willingly. The user of the website is informed whether providing this information is mandatory or not.

Pursuant to the provisions of 38 and following articles of the 78-17 law of January, 6th 1978 concerning computers files and liberties, all users have the right to access, rectify or challenge any personal data concerning themselves. To do so, a written and signed request should be sent together with a copy of signed proved identity, specifying the address where the reply is to be returned.

No user personal data shall be collected, published, transferred, disclosed freely or for payment, in any medium, without the user’s consent when visiting the website. Only the purchase of COMLIN and its rights would allow the transmission of the said information to the possible purchaser which in turn would be bound by the same obligation to retain and modify the data towards the user of the website.

The website has not been declared to the CNIL as it does not collect any personal data.

Databases are protected by the provisions of the law of July, 1st 1998 transposing the 96/9 directive of March, 11th 1996 relative the legal protection of databases.

The website contains hyperlinks to other websites, installed with the authorization of COMLIN. However, COMLIN cannot check the content of the related websites, and therefore disclaims all responsibility in this regard.

The site navigation may cause cookies to be installed in the user’s computer.

9. Applicable law and attribution of jurisdiction.

Any dispute related to use of the website is governed by French Law and shall be referred to exclusively to the courts of Paris which shall be deemed to have competent jurisdiction in such matters.
